Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AXIAL ARC, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, SUCCESSORS, AND ASSIGNS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO PROPERTY DAMAGE, PERSONAL INJURY, DEATH, LOSS OF USE, LOSS OF PROFITS, BUSINESS INTERRUPTION, OR ANY OTHER LOSS OR DAMAGE ARISING OUT OF, RESULTING FROM, OR RELATED TO THE PURCHASE, POSSESSION, INSTALLATION, USE, MISUSE, MODIFICATION, FAILURE, OR INABILITY TO USE ANY AXIAL ARC PRODUCT, REGARDLESS OF THE THEORY OF LIABILITY ASSERTED, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE.

By purchasing, possessing, installing, or using any Axial Arc product, the user expressly acknowledges and assumes all risks associated with firearm ownership, operation, maintenance, and the use of firearm-related accessories. The user further agrees that Axial Arc shall have no liability for any damages, injuries, or losses resulting from improper installation, unauthorized modifications, misuse, negligent handling, use with incompatible equipment, failure to follow manufacturer instructions, or any violation of applicable laws, regulations, or firearm safety practices.

In all circumstances, the user's sole and exclusive remedy shall be limited to the replacement or refund of the original purchase price of the applicable product, at Axial Arc's sole discretion.
